Welcome to Pumps Only, run by Corey-Jay Eyndhoven ("we", "us" or "our"). We provide a free training program (the Pumps Only ebook), general fitness information, emails about our training content, and news about the upcoming Pump or Dump app.
These terms
These terms (Terms of Use) govern your use of this website, the Pumps Only ebook and our emails (together, the Service). By using the Service, including by entering your email address to get the ebook, you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.
Privacy Policy
Your use of the Service is also subject to our Privacy Policy, which forms part of these Terms of Use.
All ages
The Service is open to all ages. If you are under 18, you confirm that you have your parent or guardian's permission to use the Service and to receive our emails, and that they have read and agree to these Terms of Use on your behalf. Parents and guardians are responsible for their children's use of the Service.
Restrictions on use
Your use of the Service is subject to the rules in Prohibited conduct below.
Violations of these Terms of Use
You may stop using the Service and unsubscribe from our emails at any time. Without limiting any other remedies available to us at law or in equity, we reserve the right to, without notice:
- temporarily or indefinitely suspend, or end, your access to the Service or refuse to provide products or services to you if:
- you breach any provision of these Terms of Use;
- we are unable to verify or authenticate any information that you provide to us; or
- we believe that your actions may cause damage and/or legal liability to us, any of our customers or suppliers or any other person; and
- remove or block access to any information and/or materials (in whole or in part) that we, at our sole and absolute discretion, regard in any way to be objectionable or in violation of any applicable law, any person's intellectual property rights or these Terms of Use.
Indemnity
You indemnify and hold harmless us and our employees, agents, consultants, licensors, partners and affiliates from and against any losses, liabilities, costs, expenses or damages (including actual losses or damages, including all legal fees on a solicitor-client basis) suffered or incurred by any of them due to, arising out of, or in any way related to (directly or indirectly):
- any material or information that you submit or otherwise make available through the Service;
- your use of, or connection to, the Service; or
- your negligence or misconduct, breach of these Terms of Use or violation of any law or the rights of any person.
Signing up
To get the ebook, you give us a valid email address and confirm it by tapping the link in the email we send you. You represent and warrant that the email address you give us is yours, is true and not misleading, and does not violate any applicable law or any person's rights. Sign-ups made by "bots" or other automated methods are not permitted, and we may accept or refuse any sign-up at our discretion.
Price
The Pumps Only ebook is free. If we offer paid products or services in the future, including through the Pump or Dump app, the terms that apply to them will be shown to you before you buy.
Dealings with third parties
Third party content and websites
The ebook links to exercise videos made and published by other creators on platforms such as TikTok, Instagram and Facebook, and the Service may link to other third party websites. We do not act as agent for any third party, and we do not recommend or endorse any third party goods or services that are listed, advertised or referred to in the Service or on any third party website. We are not responsible for the content of linked third party websites or videos, and we do not make any representations, or provide any guarantees or warranties, regarding their content or accuracy. Links may unintentionally connect to content that some users may find inappropriate or offensive. Your use of any third party website is at your own risk and subject to its own terms and conditions of use.
User acknowledgements
You acknowledge that we do not:
- check the truth or currency of any of the material or information that third parties provide or make available through the Service;
- control, endorse, approve or warrant to you the merchantability or fitness for any particular purpose of any of the goods or services of any third parties referred to in the Service;
- offer professional advice on the quality or suitability of any goods, services or information supplied by any third parties; or
- endorse or recommend any third party supplier or any third party goods or services.
Intellectual property

In these Terms of Use, "Proprietary Content" means the Service and all of its content (including the ebook and all text, graphics, designs, software, data, sound and video files and other information in the Service, and the selection and arrangement of it).
Unless we state otherwise, all Proprietary Content is our property or our licensors' property and is protected by Australian and international copyright laws. Exercise ideas credited to other creators remain theirs, and are credited and linked in the ebook. You must not reproduce, transmit, republish or prepare derivative works from any of the Proprietary Content, except as expressly authorised by these Terms of Use or with our prior written consent or that of the other copyright owner.
You may download and print the ebook and other content from the Service only for your own personal and non-commercial use, provided that you do not remove or modify any copyright, trademark or other proprietary notices. Please do not share, sell or make the ebook available to anyone else; send them to this website instead so they can get their own copy.
Trademarks
The names "Pumps Only" and "Pump or Dump" and their logos are our trademarks. The look and feel of the Service (including all button icons, scripts, custom graphics and headers) is our intellectual property and may not be used, copied or imitated, in whole or in part, without our prior written consent.
Copyright claims
If you believe that the Service contains any material that infringes any copyright that you hold or control, or links to a third party website or video that you believe infringes it, you may send us a written notice identifying the works allegedly infringed, the allegedly infringing material and the details of the alleged infringement. In response, we will give a written notice of the claim to the provider of the material. If the provider does not respond to us in writing denying the alleged infringement within 14 days after receiving that notice, we will remove or block the material as soon as is reasonably practicable. If the provider responds denying the alleged infringement, we will, as soon as is reasonably practicable, send a copy of that response to you. If you do not, within a further 14 days, file an action seeking a court order against the provider, we may restore any removed or blocked material at our discretion. If you file such an action, we will remove or block the material pending resolution of it.
Health and fitness
We provide general fitness information for a general audience. Nothing in the Service is medical advice, diagnosis or treatment, and nothing in it is personalised to your circumstances, your medical history or your condition. No relationship of doctor and patient or health practitioner and patient is created by your use of the Service, and Corey-Jay Eyndhoven is not acting as your medical or allied health practitioner. To the maximum extent permitted by law, we and our employees, agents, consultants, licensors, partners and affiliates expressly disclaim all conditions, representations and warranties (whether express or implied, statutory or otherwise) in relation to the Service and any products and/or services obtained through the Service, including any implied warranty/guarantee of merchantability, fitness for a particular purpose or non-infringement.
The Service is provided strictly on an "as is" basis. To the maximum extent permitted by law, we and our employees, agents, consultants, licensors, partners and affiliates make no representation, warranty or guarantee as to the reliability, timeliness, quality, suitability, truth, availability, accuracy or completeness of the Service or any of its content, and in particular do not represent, warrant or guarantee that:
- the use of the Service will be secure, timely, uninterrupted or error-free or operate in combination with any other hardware, software, system or data;

Limitation of liability

To the maximum extent permitted by law, we and our employees, agents, consultants, licensors, partners and affiliates exclude all liability to you or any other person for any loss, cost, expense, claim or damage (whether arising in contract, negligence, tort, equity, statute or otherwise, and for any loss, whether it be consequential, indirect, incidental, special, punitive, exemplary or otherwise, including any loss of profits, loss or corruption of data or loss of goodwill) arising directly or indirectly out of, or in connection with, these Terms of Use or the use of the Service by you or any other person.
Limitation of liability and remedies
Nothing in these Terms of Use excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Our total aggregate liability arising out of or in connection with the Service is limited to the greater of the amount you paid us in the twelve months before the claim and A$100. Where the Australian Consumer Law applies, to the maximum extent permitted by law, we limit our liability for breach of any non-excludable condition or warranty/guarantee implied by any legislation to the following remedies (the choice of which is at our sole discretion):
- in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods, or the payment of the cost of having the goods repaired; and
- in the case of services, the supply of the services again or the payment of the cost of having the services supplied again.
Release
You agree that your use of the Service is at your own discretion and risk. You agree to release us and our employees, agents, consultants, licensors, partners and affiliates from any claim, demand or cause of action that you may have against any of them arising from these Terms of Use or the use of the Service by you or any other person. We may plead this release as a bar and complete defence to any claims or proceedings.
Force majeure
To the maximum extent permitted by law, and without limiting any other provision of these Terms of Use, we exclude liability for any delay in performing any of our obligations under these Terms of Use where the delay is caused by circumstances beyond our reasonable control, and we are entitled to a reasonable extension of time to perform those obligations.
General
Interpretation
In these Terms of Use: headings are for reference only and do not define, limit or describe the scope of any provision; these Terms of Use may not be construed adversely against us solely because we prepared them; the singular includes the plural and vice versa; a reference to a "person" includes an individual, a firm, a corporation, a body corporate, a partnership, an unincorporated body, an association, a government body or any other entity; and the meaning of general words is not limited by specific examples introduced by "including", "for example", "in particular" or similar expressions.
Notifications
We may give any notice for the purposes of these Terms of Use by email to the address you signed up with.
Assignment
You may not assign, transfer or sub-contract any of your rights or obligations under these Terms of Use without our prior written consent. We may assign, transfer or sub-contract any of our rights or obligations under these Terms of Use at any time without notice to you.
No waiver
Waiver of any power or right under these Terms of Use must be in writing signed by the party entitled to the benefit of that power or right and is effective only to the extent set out in that written waiver. Any failure by us to act on a breach by you or others does not waive our right to act on that breach or any later or similar breach.
Severability
The provisions of these Terms of Use are severable and, if any provision is held to be illegal, invalid or unenforceable under present or future law, that provision may be removed and the remaining provisions will be enforced.
Variation
We reserve the right to amend these Terms of Use and any other policy on the Service at any time in our sole discretion, and unless otherwise noted any changes are effective immediately. Your continued use of the Service means you accept those amendments. We reserve the right, without notice and at our sole discretion, to change, suspend, discontinue or impose limits on any aspect or content of the Service. You may only vary or amend these Terms of Use by written agreement with us.
Governing law and jurisdiction
These Terms of Use are governed in all respects by the laws of New South Wales, Australia. The parties irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them.
Prohibited conduct
You must not:
- use any device, routine or software that interferes, or attempt to interfere, with the proper working of the Service;
- engage in any action that requires, or may require, an unreasonable or excessively large load on our infrastructure;
- use the Service to decipher passwords or security encryption codes, transmit any worms, viruses or Trojan horses, transfer or store illegal, threatening or obscene material or otherwise violate the security of any computer network;
- use the Service to violate any applicable local, state, national or international law, to engage in any misleading or deceptive online marketing practices or for any fraudulent or malicious purposes;
- use any spider, robot or search/retrieval application or any screen scraping, data mining or similar data gathering device, process, program or means to access, retrieve or index any portion of the Service;
- use the Service by any automated means, including signing up email addresses that are not yours;
- use the Service to transmit junk mail, spam or chain letters or pyramid schemes or engage in other flooding techniques or mass distribution of unsolicited email;
- reverse engineer, extract, decompile, disassemble, adapt, modify, translate, frame or reformat any of the material in the Service;
- reproduce, duplicate, copy or store any of the material in the Service other than for your own personal and non-commercial use;
- falsely imply that any other website is associated with the Service;
- do anything that leads, or may lead, to a decrease in the value of our intellectual property rights in the Service;
- use or exploit any of the material in the Service for, or in connection with, any business or enterprise (whether for profit or otherwise), including any business or enterprise that competes with the Service;
- release to the public any news release, advertising material, promotional material or any other form of publicity or information relating to us without our prior written consent; or
- use the Service to transmit any information or material that is, or may reasonably be considered to be, abusive, threatening, harassing, harmful, obscene, indecent, defamatory, unlawful, infringing, in breach of any duty of confidentiality or privacy, a misrepresentation of facts (including the impersonation of any person or entity), or likely to bring us into disrepute.
